Temporary Blocking of Red Notice

Legal Basis and Purpose
The temporary blocking of a Red Notice is an urgent measure available under Article 37 of the Statute of the Commission for the Control of INTERPOL’s Files (CCF).
In exceptional cases, the CCF may adopt provisional measures to protect an individual whose rights are at immediate risk because of data recorded in the INTERPOL Information System (IIS).

When Provisional Measures May Be Granted
The Commission for the Control of INTERPOL’s Files (CCF) may order the temporary blocking of a Red Notice when the data create an immediate and serious risk to an individual’s rights or safety.
Such provisional measures, adopted under Article 37 of the CCF Statute, are exceptional and applied only where continued circulation of the notice could cause irreparable harm or violate INTERPOL’s rules on data processing.

Where extradition proceedings are imminent and rely on a Red Notice, the CCF may order the temporary blocking of the notice to prevent arrest or transfer before the legality of the data has been examined.

If an individual is detained or subject to arrest because of information in the INTERPOL Information System, the CCF may grant provisional measures to block access to that data.

When an applicant has been granted refugee status or another form of international protection, the continued circulation of a Red Notice may conflict with international law and INTERPOL’s own rules.
